SportsiCandy.com is an entertainment platform, which provides users the ability to post photos, videos, textual information and other content for entertainment purposes.

Read these terms and conditions carefully before using the website and or its services in any way. If you do not agree to the terms and conditions of SportsiCandy (hereafter used interchangeably with SIC) do not use the website.

CONTENT POLICIES….You hereby represent that you are at least 18 years of age on that date that you submit any content to the SIC website as noted in these Terms / Conditions / Privacy Policy.

All content (“submissions”),including images, videos, text, links, comments, ideas and suggestions and other types of media/data (“material”) transmitted by you onto the site shall remain your sole and exclusive property and be solely responsible for the submission of material and the consequences of submitting material to the site by posting it, sharing it, commenting and suggesting it on/to the site. Any material submitted is deemed to be public information.

 

You also represent and warrant that the material does not infringe trademarks, patents, publicity rights and copyrights; does not depict a person or any information about the person younger than 18 years old in any form.

 

You also warrant that if you own all of the rights to the material that public use of the material by SIC will not infringe or violate any law, regulation or rights, including but not limited to confidentiality, privacy and copyrights of any third party. You acknowledge that SIC has no knowledge of your rightfulness to submit/modify any material to the site and/or users of the site and you waive the right to make any claim against SIC in connection with the material you submit within your activity.

 

DISCLAIMER….. SIC shall not be assumed to monitor the material submitted or generated by the users of the site; neither should it be assumed to endorse any material submitted, opinions and views expressed by the users of the site; and reserves the right without any obligations to remove, move or edit any material at its own discretion in full or in part from the site, without any notification.

 

Submission / Uploading of Photos, Videos and other features identified by Name, Sport Category, Sport Name, Enter Caption, Name of Person, Designer, Ride in Image, Animal / Pet Name, Keywords / Categories, Country, State, USA or International College or University, Team Name, View, Comment & Share, Forum, Contests / Polls and related components are for entertainment or illustration purposes only. Selected advertisements may be used for design and specimen consideration. If you believe content has been posted incorrectly or without your permission and you wish it removed…send us an email to sic1@optimum.net after review by SIC, if warranted it will be removed.

INDEMNITY….. You agree to indemnify, defend and hold harmless SIC, its parent and affiliated companies, their licensees, successors and assigns, and each of their officers, agents and employees from all liabilities or losses, including, without limitation, reasonable attorneys’ fees, arising out of or related to SIC exercise of the rights granted herein in any way connected with (i) your access to or use the Site, Application, Services or Site Content, (ii) your User Content, or (iii) your violation of these Terms.

This license shall be governed by the laws of the State of New Jersey.

INTELLECTUAL PROPERTY RIGHTS AND NOTICES……. All contents of the SIC Site and Services including but not limited to design, text, software, technical drawings, domains, service marks, configurations, graphics, other files, other intellectual property and their selection and arrangement (“Content”) are trademarked by SportsiCandy LLC., and/or the proprietary property of SIC’s suppliers, affiliates, or licensors. Content may not be reproduced, modified, derivative works created from, displayed, performed, published, distributed, disseminated, broadcasted or circulated to any third party (including, without limitation, the display and distribution of the material via a third party Web sites or other networked computer environment) without the express prior written consent of SIC and/or it suppliers, affiliates, or licensors. All rights reserved.

No agency, partnership, joint venture, or employment is created as a result of the Terms of Use and you do not have the authority of any kind to bind SIC in any respect whatsoever. These Terms of Use, and any disputes arising from or relating to the interpretation thereof, shall be governed by and construed under New Jersey law.

COMMENTS…… In order to enhance their use of the SIC website, users can choose to leave comments and rank on particular articles, photos, videos, forums, blogs and other features of interest. SIC does not endorse unless expressly granted any User Submission or any opinion, recommendation, or advice expressed therein, and SIC expressly disclaims any and all liability in connection with User Submissions. SIC may remove or modify any content without notice or liability at any time in its sole discretion.

USE OF MATERIAL…..Your right to make use of SIC websites and any Material or other content appearing on it is subject to your compliance with these Terms of Use.

You may access and display Material and all other content displayed on SIC websites for non-commercial, personal, entertainment use on a single computer only and are subject to your keeping intact all copyright and other proprietary notices. Using any Material on any other web site or networked computer environment is prohibited.

The Material and all other content on SIC websites may not otherwise be copied, reproduced, republished, uploaded, posted, transmitted, distributed or used in any way unless specifically authorized by SIC.

USER SUBMISSIONS AND CONDUCT…… You represent and warrant that the material submitted / generated by you or your activity on the SIC website is not misleading, unlawful, obscene, depicting or provoking racism, child exploitation, hatred or profanity, threatening, harassing, abusive, deceptive, fraudulent, invading privacy, intellectual property or confidentiality of third parties, or violating terms and conditions of SIC. Do not upload images with graphic nudity, sexually suggestive content*, content harmful to minors, pornographic, weapons, graphic violence, or gang affiliation or your account will be terminated and all profile information deleted.

* The exception is limited to having the ability to post suggestive sexual photos only on the iCandyXtra feature. You also represent and warrant that the material does not infringe trademarks, patents, publicity rights and copyrights; does not depict a person or any information about the person younger than 21 years old in any form.

If SIC receives notice that any posting is not in keeping with these terms and conditions, SIC may remove that posting and/or any other related postings without notice.

You retain all of your ownership rights in your User Submissions. By submitting your videos/photos and relative content for good and valuable consideration, the sufficiency and receipt of which you hereby acknowledge, including submission to but not limited to the any current or any other features that SIC may have, edit or include in the future, you hereby grant to SIC a non-exclusive, perpetual, worldwide license to edit, telecast, rerun, reproduce, use, syndicate, license, print, distribute and otherwise exploit the materials you submit, or any portion thereof, as incorporated in any of SIC programming or the promotion thereof, in any manner and in any medium or forum, whether now known or hereafter devised, without making payment to you or any third party. You represent and warrant to SIC that you have the full legal right, power and authority to grant to SIC the license provided for herein, that you own or control the complete exhibition and other rights to the materials you submitted for the purposes contemplated in this license and that neither the materials nor the exercise of the rights granted herein shall infringe upon or violate the right of privacy or right of publicity of, or constitute a libel or slander against, or violate anyway the Terms of this agreement.

In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have all the necessary licenses, rights, consents, and permissions to use and authorize SIC to use all patent, trademark, trade secret, copyright or other intellectual property or proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the SIC website and these Terms of Service.

NOTICE TO OWNERS OF COPYRIGHTED WORKS…. All images on SIC are submitted to SIC either directly to the site by the user completing the submission requirements for each feature offered; emailed, by mobile phones or tablets, webcam, browser, or other electronic devices; posted by non-members or are readily available in various places on the Internet and believed to be in public domain. Images posted are believed to be posted within our rights according to the U.S. Copyright Fair Use Act (title 17, U.S. Code.) It is SIC’s policy, in appropriate circumstances and at its discretion, to disallow content that repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the SIC site please send any issues including a link to the photo or video to:

THIRD-PARTY SITES / LINKS….. The site SIC may contain links or advertisements to third-party sites. SIC shall assume no responsibility for the material / content, privacy policy and other practices used by them; does not guarantee, approve or endorse the information or products available at these sites, nor does a link indicate any association with or endorsement by the linked site to the SIC website unless expressly noted by SIC. You represent that you are solely responsible for visiting and/or using third-party sites and acknowledge that SIC is not subject to any liability connected with their use.

 

TERM AND TERMINATION….Terms or Use shall continue until terminated as set forth in this Section, in its sole discretion, may terminate or suspend user accounts at any time for any reason or no reason at all, without prior notice or liability to you.
